User Responsibility for OpenAI Costs:
All costs related to the usage of OpenAI's services via iamsam.ai are the sole responsibility of the user. Users must ensure they have sufficient funds in their OpenAI account to cover the usage costs.
Token Insertion and Management:
Users must input their personal OpenAI token into the iamsam.ai platform to initiate the AI services. Users are responsible for managing and renewing their OpenAI tokens as needed.
No Additional Charges for Messages:
iamsam.ai will not charge users for the AI-generated messages. The costs incurred for these messages are directly managed and billed through the user’s OpenAI account.
Misuse of OpenAI Token:
iamsam.ai is not responsible for any misuse or unauthorized use of the user's OpenAI token. Users must safeguard their tokens and are liable for any actions taken with their tokens within the iamsam.ai platform.
Service Fees by iamsam.ai:
While iamsam.ai does not charge for the AI-generated messages, users are still subject to fees for using the iamsam.ai site, widget, and message capabilities as detailed in our pricing structure.
Compliance with OpenAI Policies:
Users are required to adhere to all terms and conditions set forth by OpenAI in the usage of its API and services. Any violation of OpenAI's policies may result in termination of the user's access to iamsam.ai services.
Updates and Changes:

Subscription Model, Upgrades, Downgrades, and Termination Rights
The subscription agreement entered into by the user with iamsam.ai is based on a monthly recurring model. Such subscription shall automatically renew at the conclusion of each monthly period, unless and until terminated by the user or iamsam.ai as detailed herein.
Upgrades:
If a user opts to upgrade their subscription tier during an active billing cycle, they won't be charged immediately. Instead, the differential amount, calculated on a prorated basis, will be charged at the beginning of the subsequent billing cycle. This prorated amount represents the difference in cost between the user's current plan and the upgraded plan for the remaining portion of the previous billing cycle.
Downgrades:
In the event that a user chooses to downgrade their subscription level, they will not receive a direct monetary refund. Instead, the difference in cost, calculated on a prorated basis for the remaining period of the billing cycle, will be credited to their iamsam.ai account. This credit can exclusively be used towards future subscription fees on our platform.
Cancellation:
Notwithstanding the aforementioned automatic renewal, users maintain the inherent right to terminate their subscription agreement at their discretion. Upon such voluntary termination, the user shall continue to access the platform's services until the culmination of the prevailing monthly billing cycle. It's important to note that, regardless of when a cancellation is effected, no partial refunds for that month's fee will be provided.

Iamsam.ai prohibits the creation of chatbots for illegal activity.
Child Sexual Abuse Material or any content that exploits or harms children

Generation of hateful, harassing, or violent content
- Content that expresses, incites, or promotes hate based on identity.
- Content that intends to harass, threaten, or bully an individual.
- Content that promotes or glorifies violence or celebrates the suffering or humiliation of others.
Generation of malware
- Content that attempts to generate code that is designed to disrupt, damage, or gain unauthorized access to a computer system.
Activity that has high risk of physical harm, including:
- Weapons development.
- Military and warfare.
- Management or operation of critical infrastructure in energy, transportation, and water.
- Content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders.
Fraudulent or deceptive activity, including:
- Scams.
- Coordinated inauthentic behavior.
- Plagiarism.
- Academic dishonesty.
- Astroturfing, such as fake grassroots support or fake review generation

All data inputted by users into iamsam.ai remains the property of the user. iamsam.ai does not claim any ownership rights over such content. The only rights we maintain pertain to ensuring the generated content complies with our usage guidelines, primarily to meet OpenAI's moderation endpoint standards. Outside of this moderation process, no other rights or licenses are granted to our platform regarding user content.As reiterated, users must adhere to the content standards and guidelines previously mentioned to ensure that their interactions and chatbot creation remain within acceptable parameters.
Payment and Pricing
iamsam.ai offers two main subscription tiers:
- Basic Plan: $4.99/month
- Premium Plan: $9.99/month
Payments can be made using major credit cards. Subscriptions are auto-renewed every month. Users can cancel their subscription anytime, but the service will continue until the end of the current billing period. There are no refunds available, except under specific conditions. If a user forgets to cancel and can demonstrate a lack of usage, a refund request can be made within 14 days of the charge. No refunds will be processed if claims are made 15 days after the charge. In instances of missed or failed payments, we reserve the right to cancel the subscription. Affected users will receive an email notification about the cancellation and will have the option to reactivate their account.
Intellectual Property Rights
Ownership:
All rights, titles, and interests in and to the service, software, trademarks, and associated intellectual property, known as "iamsam.ai," are owned by Snapi LLC.
License to Users:

Termination and Suspension of Service

Grace Period:
In the event of content disapproval or flagging, users will receive an email notification and must make necessary adjustments within 7 days. Failure to comply may result in account termination.
Warranties and Disclaimers

iamsam.ai is provided "as is," and while we strive to offer a reliable service, we make no warranties regarding its uninterrupted functionality, availability, or reliability.
Exclusions:
We do not guarantee specific results from using our service. Additionally, we are not responsible for third-party integrations or any actions users take based on our AI's suggestions. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, whether under contract, tort, or any other theory of liability, even if we have been advised of the possibility of such damages.

Indemnification
You agree to defend, indemnify, and hold harmless Snapi LLC, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or accruing from your violation of these T&Cs or misuse of the service.
Changes to the Terms
Snapi LLC reserves the right to modify these terms and conditions at any time. We will provide notice of these changes by sending an email to the email address associated with your account. Your continued use of the service after a 30-day notice period will be deemed as your acceptance of the modified terms.
Governing Law and Dispute Resolution
These terms and conditions are governed by and construed in accordance with the laws of the state of Florida, USA. Any disputes relating to these terms and conditions will be subject to the jurisdiction of the courts of Florida, unless otherwise required by applicable law.
Integration and Severability
These T&Cs constitute the entire agreement between you and Snapi LLC regarding the use of the service and supersede all prior agreements or understandings, whether written or oral, relating to the subject matter hereof. If any provision of these terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions remain in full force and effect.
